Police say a man driving a Subaru chased down a motorcyclist on the highway shoulder, then collided with the biker. The car flipped onto the Yamaha motorcycle; passers-by stopped to rescue the rider by lifting the Subaru off of him.

Authorities have charged a Beaverton man, David J. Bumgardner, with felony assault after he allegedly crashed his Subaru into a motorcycle ridden by a Vancouver man Wednesday afternoon.

Police said both the car and motorcycle were eastbound on U.S. 26, the Sunset Highway, at the Southwest Sylvan Road overpass around 3 p.m., when the motorcycle rider, 47-year-old Tha Ouk, was “lane splitting” — riding between lanes when auto traffic is stopped or moving slowly. That is illegal in Oregon.

Bumgardner, 60, responded by driving onto the shoulder and pursuing Ouk down the highway, according to police. Authorities said the motorcyclist stopped for a lighted traffic control sign on the shoulder and Bumgardner was unable to stop, crashing into Ouk’s Yamaha bike just west of the Oregon Zoo exit.

The Subaru rolled onto Ouk’s body, according to police, who said passing drivers rescued the biker by lifting the vehicle high enough to free him. An ambulance took Ouk to a hospital with serious but non-life-threatening injuries.

Bumgardner, who reported no injuries, faces charges of third-degree assault, reckless driving and recklessly endangering another person.

Police cited Ouk for driving without insurance, careless driving, failing to drive within a lane, driving without a motorcycle license and failing to register his motorcycle.
